YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT
DO NOTHING

To receive your Individual Settlement Share, you do not need to do anything.

Your payment will be automatically mailed to you after the Court grants final approval of the Settlement and final judgment is entered.

OPT IN TO FLSA SETTLEMENT

To receive your FLSA Settlement Share, if applicable, you need to return or submit online, the FLSA Opt-In Form to the Claims Administrator by October 10, 2022. See Section VII for details.

EXCLUDE YOURSELF FROM THE SETTLEMENT

You may request to be excluded from the Settlement if you do not wish to participate in the Settlement. If you request exclusion, you will not receive any Individual Settlement Payment under the Settlement. This is the only option that allows you to pursue your own claims (in your own lawsuit) against Ecolab about the legal claims in this case. If you want to exclude yourself from the Settlement, you must follow the instructions in Section VII and submit your request for exclusion to the Claims Administrator by October 10, 2022.

Untimely requests for exclusion will be rejected.

OBJECT TO THE SETTLEMENT

You may submit written objections by October 10, 2022 if you think the Settlement is not fair. See Section VII for instructions on how to object to the Settlement

A Settlement Class Member who objects to the Agreement, but does not submit an Opt-Out Form, will remain a Class Member.

APPEAR AT A COURT HEARING

You may ask to speak in court about why you think the Settlement is not fair. It is not necessary for you to appear at the hearing, although you may do so if you wish.
